Terms of Service — ToyTales

These Terms of Service (“Terms”) govern your use of the ToyTales mobile application (the “App”) operated by ToyTales (“we”, “our”, or “us”). By using the App, you agree to these Terms.

1. Service Description

ToyTales is a mobile application that uses artificial intelligence to generate personalized coloring pages and comic books from user-uploaded photographs of toys. The App is intended for use by parents and guardians to create child-friendly content.

2. Eligibility

You must be at least 13 years old to create an account and use ToyTales. The App is designed for parents and guardians to use on behalf of their children. By using the App, you represent that you meet this age requirement.

3. Account

You may sign in using Apple or Google authentication. You are responsible for maintaining the security of your account. You may delete your account at any time via Settings > Delete Account in the App.

4. User Responsibilities

Upload only photographs that you have the right to use.
Do not upload content that is inappropriate, offensive, illegal, or harmful.
Do not attempt to circumvent content moderation filters or safety mechanisms.
Do not use the App for any purpose other than its intended use (creating child-friendly coloring pages and comic books).

5. AI-Generated Content

Coloring pages, comic book panels, stories, and other content are generated by third-party AI services (OpenAI and Google Gemini).
We implement content moderation including safety filters and prompt sanitization to ensure child-appropriate output, but no automated system is 100% effective. If you encounter inappropriate content, please report it to support@toytales.app.
AI-generated content is provided for personal, non-commercial use. You may save, print, and share generated content with family and friends.
We do not guarantee the accuracy, quality, or appropriateness of AI-generated content. Generated content should be reviewed by a parent or guardian before sharing with children.

6. Free Tier and Limits

The free tier of ToyTales includes:

Unlimited coloring page generation
Up to 3 comic books per month
Up to 20 saved toys

These limits may change at our discretion. We will notify users of significant changes to the free tier.

7. Intellectual Property

You retain ownership of the photographs you upload. AI-generated content (coloring pages, comics, stories) is created for your personal use. The ToyTales name, logo, and app design are our intellectual property.

8. Service Availability

ToyTales depends on third-party AI services and cloud infrastructure. We do not guarantee uninterrupted service. Content generation may occasionally fail due to API limitations, network issues, or service outages. We are not liable for service interruptions.

9. Content Moderation

We filter all prompts and outputs to ensure child-appropriate content using multiple safety layers, including keyword filtering, safety phrase injection, and automatic retry with safer prompts. Despite these measures, we encourage parents to review generated content before sharing it with children.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to uploading inappropriate content or attempting to abuse the service. You may delete your account at any time, which will permanently remove all your data.

11. Limitation of Liability

To the maximum extent permitted by law, ToyTales is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages from AI-generated content, service interruptions, or data loss.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted at this URL (toytales.space/terms). Continued use of the App after changes constitutes acceptance of the updated Terms.
